Attorneys for six Baltimore police officers charged in the death of Freddie Gray last month say prosecutor Marilyn Mosby's office should be taken off the case,
CNN reports.
In a motion filed in Baltimore City District Court, they cite an array of concerns.
The lawyers allege that Mosby and her husband, Baltimore City Council member Nick Mosby, stand to gain politically and financially from the case; that she has personal relationships with potential witnesses; and that an attorney for Gray's family is a close friend and supporter of Marilyn Mosby.
The final allegation most likely refers to attorney
William H. "Billy" Murphy Jr., who raised money for Mosby's election campaign last year, served as a member of her transition team, and contributed $5,000 to her campaign.
The defense motion is the latest call for Mosby's removal from the case. Last week, a Fraternal Order of Police lodge asked Mosby to appoint a special prosecutor because of her ties to Murphy.
In a letter to Mosby explaining the request, FOP Lodge 3 President Gene Ryan objected to "your personal and professional relations" with Murphy and said that to "avoid any appearance of impropriety or a violation of the professional Rules of Professional Responsibility, I ask that you appoint a Special Prosecutor to determine whether or not any charges are filed."
Meanwhile, the politics surrounding the Gray case has apparently spilled over into a separate court case in which Marilyn Mosby and Billy Murphy are involved, the
Baltimore Sun reports.
The case involves Baltimore police officers accused of animal cruelty for allegedly slitting a dog's throat while responding to a disturbance last summer.
In a motion filed Thursday, a defense attorney questioned whether Mosby's decision to drop charges against one of the officers occurred because he was represented by Murphy's law firm. The lawyer represents another officer accused in the dog's killing who still faces animal-cruelty charges.
