Florida Lawmakers Aim to Fight Federal Overreach

Lawmakers in Florida have introduced a bill that would create a commission to monitor federal overreach.

The Daily Signal reports the proposal is currently in the Florida Senate.

According to The Daily Signal, "The commission would evaluate any 'federal law, agency policy, mandate, or executive order' that 'is not authorized by the powers delegated to the Federal Government or any of its agencies under the United States Constitution or violates the principle of federalism.'"

The commission, according to the report, would consist of senior political leaders in the state legislature. It would be tasked with keeping an eye on the federal government and would sound the alarm when it feels Uncle Sam is stepping on the boundary between federal powers vs. state powers.

"Contrary to what some maintain, individual states do not have the power to unilaterally nullify federal laws," David Azerrad writes in The Daily Signal. "But they do have the duty to voice their opinion, in the strongest possible terms, when the federal government violates the Constitution or oversteps the limits of its authority.

"The proposed commission is thus tasked with drawing attention to federal violations of the principle of federalism."

If Florida passes the measure, other states could potentially follow. That could eventually force lawmakers in Washington to be more aware of states' powers when they're putting together legislation, Azerrad writes.

A report last year, meanwhile, said states are beginning to fight federal overreach. Some critics point to the Affordable Care Act and gun control laws as examples of this.

Several states have launched efforts to shed some of the requirements Obamacare places on their residents who use the federal healthcare system.

Former New Jersey Superior Court Judge Andrew Napolitano said last summer that President Barack Obama has far exceeded his powers and is using executive overreach to put his hand in too many jars.

"President Obama has taken the concept of discretion and so distorted it, and has taken the obligation of faithful enforcement and so rejected it, that his job as chief law enforcer has become one of incompetent madness or chief lawbreaker," Napolitano wrote.
