Reading his opinion from the bench, Judge Sauls decisively announced that based on the law and the facts, Gore did not present a proper case and failed to meet the burden of proof required to overturn an election.
Further, the judge ruled that in order to bring a statewide case in an election contest, every single county in the state must be included, not a select few.
Some of the strongest language in the decision was used to condemn the attempt to sanction the use of 'changing rules' in assessing votes, which, the judge noted, would be in inviolation of Section 5 of Title III of the U.S. Code, which expressly prohibits such action.
