President Joe Biden’s determination to nominate a Black woman as the next justice on the Supreme Court of the United States proves Democrats “believe in racial discrimination,” Sen. Ted Cruz, R-Texas, argued Sunday.
In an interview on “Fox News Sunday,” Cruz blasted the focus of the search for a successor to the retiring Justice Stephen Breyer, who has announced he’ll step down in June.
“Democrats today believe in racial discrimination,” Cruz charged. “They are committed to it as a political proposition.”
“What the president said is that only African American women are eligible for this slot, that 94% of Americans are ineligible,” Cruz asserted. “Merrick Garland, whom [former President] Barack Obama nominated to the Supreme Court, Merrick Garland was told ‘sorry, got the wrong skin color, wrong gender, you are not eligible to be considered.’”
Cruz lamented the United States “has such a troubled history on race.”
“We ought to move … past discriminate based on race,” he said.
“If Fox News put a posting, ‘we are looking for a new host for Fox News Sunday and we will only hire an African American woman or Hispanic man or a Native American woman,’ that would be illegal.”
“Nobody else can do what Joe Biden did, and there's a reason for that,” Cruz said. “Racial discrimination is wrong."
Some of the potential candidates for the Supreme Court vacancy are South Carolina federal Judge J. Michelle Childs, D.C. Circuit Judge Ketanji Brown Jackson, California Supreme Court Justice Leondra Kruger and NAACP Legal Defense Fund president Sherrilyn Ifill.
