Sen. Graham: Roe V. Wade Is "Settled Law," But Doesn't Mean It Can't Be Overturned

The opinion that Roe v. Wade is “settled law” doesn’t mean it can’t be overturned by the Supreme Court, Sen. Lindsey Graham, R-S.C., said Sunday.

In remarks on “Fox News Sunday” about high court nominee Brett Kavanaugh’s position of the ruling that legalizes abortion, the South Carolina Republican said he "wouldn't vote for anybody that says that every decision [of] the Supreme Court cannot be revisited… through a process… of overturning long precedent.

He would be disqualified, in my opinion, if you would not listen to both sides of the story and decide accordingly,” he said.

Graham predicted the conservative nominee will pass confirmation in the Senate with at least 55 votes; hearings begin this week.

“I think there are a handful of Democrats [that] will vote for Judge Kavanaugh if he does well, and maybe even more,” he said.

Graham also pushed back on some Democrats’ calls for a wait on confirmation until a probe of accusations against President Donald Trump by his former lawyer, Michael Cohen, is completed.

"My Democratic friends did not have this view when [Bill] Clinton was president,” Graham said, referring to an independent counsel’s investigation of Clinton in 1994 at the time Justice Stephen Breyer was confirmed.
