Jay Sekulow: Why No Special Counsel on Obama?

One of President Donald Trump's attorneys Wednesday demanded to know why there is no special counsel investigating former President Barack Obama over Russia, while saying his client and the American public are owed an apology for the "witch hunt" that is happening.

"Why do we have a special counsel dealing with the Russia hacking, when they had that evidence and did nothing?" attorney Jay Sekulow told Fox News' "America's Newsroom" that he'd like to ask Democratic nominee Hillary Clinton's campaign chairman John Podesta.

He made his comments in response to statements Podesta made to reporters — following his testimony behind closed doors — that Obama and his administration were dealing with an unprecedented incident of the weaponization of the fruits of Russian cyberactivity, and "I think they were trying to make the best judgments they could on behalf of the American people."

The Obama administration did not, until about a month before the election, formally blame Russia for hacking activities during the primary, including on the Democratic National Committee.

"I'm telling you what I think is owed here: an apology to the president, an apology to the American people," Sekulow said Wednesday.

"When the president said early on that this was a witch hunt, [with] every day that goes by, I'm not sure that's fair to witch hunts to keep calling it a witch hunt. It's beyond that."

Sekulow said he'd also like to see Obama be called to testify before Congress.

"I would like to hear that explanation," the attorney said. "There has been this media frenzy on the so-called Russia colluding . . . I would ask President Obama this question: If you were so concerned about Russia hacking two things, number one, why didn't you do anything about it?

"Number two, why did you tell the American people in October that, in fact, there was no way the Russians could interfere with our election? That couldn't happen, no way they can change a vote, no way they can interfere with an election."

Sekulow said he also wants to hear former Attorney General Loretta Lynch's explanation.

"The previous administration, President Obama, was fully aware what was going on," he argued. "He was briefed by Intel officials but did nothing, because he made a decision to 'not get involved in the election' which really meant, we knew in his view that Hillary Clinton was going to win.

"I think the American people have the right to get some answers here."
