Democrats are saying they plan to use the Trump administration's decision to join a lawsuit that challenges Obamacare protections to take on his eventual Supreme Court nominee, HuffPost reported.
The lawsuit, brought by 20 states that are led by Republicans, argues tha since Obamacare's individual mandate requiring insurance is no longer enforced, protections for customers who have preexisting medical conditions should also not be enforced, HuffPost reported.
Democratic senators are likely going to ask the nominee for their position on Trump joining the lawsuit. If nominees punt on the question, Democrats would be likely to look at past rulings and writing on the issues, the HuffPost report said.
The Supreme Court nominee fight will also require Republicans to focus on healthcare, which has not been a recent priority: Republican spending on TV ads that mention Obamacare has dropped compared with recent election cycles, while Democrat spending on such ads has increased, HuffPost reported in April.
Polls show that the protections for preexisting conditions are popular with most of the public and a recent Kaiser Family Foundation poll found that 76 percent of voters, including 58 percent of Republicans, think Obamacare's coverage for preexisting conditions was "very important."
