The Ninth Circuit Court of Appeals on Wednesday dealt another blow to President Donald Trump, temporarily blocking the use of military funds to build a border wall.
A three-judge panel of the San Francisco court, which Trump has frequently attacked, refused a request to halt temporarily a lower-court ruling banning military funds from being diverted for use in construction of the wall along the southern border, the The Washington Times reported.
“The use of those funds violates the constitutional requirement that the Executive Branch not spend money absent an appropriation from Congress,” the 9th Circuit judges wrote in the 2-1 decision, according to the news outlet.
According to The Hill, the order applies to some of the military funds tapped by Trump for the wall.
Trump declared a national emergency earlier this year to tap Defense Department funds to build the wall, a long-promised goal of the president.
