Alabama, Louisiana AGs Defend Joining Texas Election Lawsuit

Attorneys General Steve Marshall of Alabama and Jeff Landry of Louisiana said Thursday they joined in with Texas Attorney General Ken Paxton's lawsuit filed with the Supreme Court because they are asking that only legal ballots are counted. 

"When you look at the constitution, you recognize that there were states under which non-legislative actors, that means like governors, secretaries of state or state courts, basically modified election law in the midst of the game," Landry said on Fox News' "Fox and Friends." "We don't believe it's proper. 

Marshall said the 17 states that have come together for the lawsuit believe Texas has presented a "compelling argument" about why the Constitution compels the court to take the case.

Wisconsin Attorney General Josh Kaul has criticized the lawsuit, saying it is misleading the public, but Landry said he thinks the American people and President Donald Trump deserve to know if the election took place on a fair playing field. 

"You can't change the rules midstream," said Landry. "If our election system doesn't have integrity to it, we lose our entire form of government. Democracy basically fails, and I think that the court should take that matter up. The question is whether or not non-legislative actors can change the rules of the game midstream."

The Supreme Court declined to hear a case brought by Pennsylvania Republicans because it was not brought in a timely manner, said Marshall, but the Texas case against Wisconsin, Michigan, Georgia, and Pennsylvania is timely and it would be appropriate for them to hear it. 

"Many people could argue that yeah, maybe the campaign could have challenged these before," said Landry. "Certainly that's what the supreme court said in the Pennsylvania case with congressman Mike Kelly."

Landry and Marshall will join other GOP attorneys general in a meeting with Trump at the White House Thursday. They said the discussion will include the lawsuit, and also the goals moving forward for Trump serving another four years in the White House.
