Napolitano to Newsmax: 'Profoundly' Disagree With Pushing Trump off '24 Ballot

Former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Tuesday he "profoundly" disagrees with the pushing of rhetoric to keep former President Donald Trump off state ballots in 2024.

During an interview on "American Agenda," Napolitano made it a point that he "profoundly" disagrees "with those who say that Donald Trump can be kept off the ballot because of a decision by a bureaucrat based upon what the bureaucrat perceived from the media."

"If Donald Trump were convicted by a jury of having participated in an insurrection, and he hasn't even been charged with that — the January 6th case against him, is not accusing him of being an insurrectionist — but only then could [he] be kept off the ballot," Napolitano added.

On Sunday, ABC News ran an article about Hillary Clinton's 2016 running mate and Democrat Senator of Virginia, Tim Kaine, saying he believes strongly that the federal government could use the 14th Amendment to remove Trump from the ballot in 2024.

"In my view," Kaine told ABC's "This Week," that "the attack on the Capitol that day was designed for a particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power as is laid out in the Constitution. So I think there's a powerful argument to be made."

During an interview with Tucker Carlson, former Capitol Police Chief Steven Sund, who was in charge of Capitol security on Jan. 6, 2021, said that for 71 minutes, former House Speaker Nancy Pelosi did not approve of sending in the National Guard.
