Tom DeLay to Newsmax TV: Kavanaugh Hearings are Yielding 'Debate on the Constitution'

The confirmation hearings for Supreme Court nominee Judge Brett Kavanaugh are less about Kavanaugh himself and more about the Constitution, former House Majority Leader Tom DeLay told Newsmax TV.

During an appearance on Wednesday's "America Talks Live," DeLay said the hearings, which kicked off Tuesday, are turning into a healthy debate on the Constitution.

"I see this as more than just Kavanaugh. This is a debate on the Constitution," DeLay said. "On one side, you see the Democrats, but when you talk about policy … you're not supposed to vote for [judges] on what they believe in or what their policy [is] because the judiciary is not supposed to be involved in policy. They're supposed to interpret the statutes, interpret the Constitution.

"And the Democrats are all upset, and they're gonna vote against him because he's a conservative."

DeLay then referenced a speech made during Tuesday's hearing session by Sen. Ben Sasse, R-Neb., in which he tried to give Democrats a civics lesson around the Kavanaugh hearings.

"The statement made by Sen. Ben Sasse was just absolutely outstanding. He talked about the separation of powers, the fact that the Congress isn't doing its job, that the executive branch is not doing its job, the judiciary not doing its job to keep their powers separated and to hold each other accountable," DeLay said.

DeLay noted that he would like to see Kavanaugh speak more about the Constitution during the hearings.

"He's been there, he's been right up to the edge, and I'm hoping in the next couple of days … before they finish that he gets more opportunity to talk in those terms," DeLay added.
