Sen. Marsha Blackburn to Newsmax: It's Trump's 'Constitutional Duty' to Nominate Justice

It's the constitutional duty" of President Donald Trump to nominate someone as soon as he can to fill the vacancy left on the Supreme Court after the death of Ruth Bader Ginsburg, Sen. Marsha Blackburn, R-TN., told Newsmax TV.

"One of the things that we know is that the president has a constitutional duty. This is a power that is given to him as the president of the United States, Blackburn told Monday's "Greg Kelly Reports."

Blackburn continued, "It is his responsibility to nominate someone for the bench. it is our responsibility in the Senate to provide the advice and consent."

Federal judges Amy Coney Barrett and Barbara Logoa are viewed as the favorites as the next nominee to fill the seat vacated by Ginsburg.

In the history of the United States, the 29 Supreme Court vacancies have opened up during election years.

Blackburn added, "It is appropriate that we should do this ... You'd have to go back to 1888 to find a time when the president and senate of the same party did not move forward in making this nomination.
