The decision about whether to prosecute Ferguson, Missouri, police officer Darren Wilson in the fatal shooting of Michael Brown boiled down to one key issue, says former federal prosecutor Doug Burns, a legal analyst on television and radio.
"I don't think anybody can seriously maintain after studying the evidence that the victim didn't reach into the car, and so the officer shot him and grazed his hand," Burns on Wednesday told Rick Ungar, guest host of "The Steve Malzberg Show" on
Newsmax TV.
"That's fine, but that's not the end of the story, because ostensibly, that fight could have ended and then he's elsewhere. So the real question, real simple, is, was he charging him or was he retreating and surrendering? It's that simple. It's the whole case."
