Judge Napolitano to Newsmax: Trump Can't Sue Biden

Even though President Joe Biden on Monday misled the public in a speech about how former President Donald Trump responded to last week's mass school shooting in Perry, Iowa, former New Jersey Superior Court Judge Andrew Napolitano told Newsmax that Trump has no grounds to sue Biden for slander.

"No, no, no. They are both public figures whose megaphones are so huge," Napolitano told "Carl Higbie FRONTLINE" on Monday.

During a campaign stop at Mother Emanuel AME Church in Charleston, South Carolina, site of a racially motivated mass shooting in 2005, Biden cherry-picked what Trump said during a campaign speech Friday in Sioux Center, Iowa, about the school shooting that left an 11-year-old dead and several other students and staff injured.

"It's hard to believe. You know what his response was?" Biden said. "All those kids dead. 'We have to get over it.'"

What Trump did say after expressing condolences, love, and prayers for the victims was, "We have to get over it. We have to move forward. To all the relatives, and all the people who are devastated right now, to the point they can't breathe, they can't live, we are with you all the way. We love you and cherish you."

"I profoundly disagree with [what] Joe Biden said," Napolitano said. "He materially misled the audience about what Donald Trump said. Donald Trump understands that the right to keep and bear arms is a fundamental natural human right. It's the modern manifestation of your right to self-defense. That's not me. That's the Supreme Court of the United States.

"Joe Biden doesn't understand that. But when it comes to what these guys say about each other, let's face it, it's a political season. Anything goes. The courts don't want to get involved. The public will decide, and we know which way they're leaning. The public will decide which of the two of them they believe."
