Alan Dershowitz: FBI Leaks Must Be Plugged for Good of Country — Now

The Federal Bureau of Investigation has too many leakers within its ranks — an "unhealthy" problem that is hurting the nation, renowned civil-rights lawyer Alan Dershowitz tells Newsmax TV.

"He's a good man, [FBI director] Jim Comey, but he doesn't seem to be able to control his agents in terms of leaking. They're now leaking information which is against the law," Dershowitz, a Harvard law professor emeritus, said Monday to Steve Malzberg on "America Talks Live."

"So once this election is over, we're going to have to revisit the FBI situation and figure out a way of plugging these leaks because whether it's Democrats who are being attacked or Republicans. It's unhealthy when the FBI leaks information."

Dershowitz's suggestion comes in the wake of reports that FBI employees leaked shared information about the agency's renewed probe of Hillary Clinton's private server.

Comey is under fire for revealing 11 days before the election that the FBI had reopened its Clinton probe based on new 650,000 emails seized from disgraced ex-congressman Anthony Weiner's personal laptop — a disclosure some fear will sway the presidential election.

On Sunday, Comey said a review of those tens of thousands of emails revealed nothing new and that the investigation was again closed. That announcement was blasted by Donald Trump who insisted the agency could not possibly review so many emails in just over a week.

But the Republican presidential nominee's claim is not true, according to Dershowitz.

"Donald Trump is wrong as a matter of fact. The FBI can review hundreds of thousands of emails. They're only trying to determine two things," Dershowitz said.

"One, are they duplicates? That they can do by a simple mechanical device through a computer technology they have. The second, they can by looking at headings and having thousands of agents review, determine whether or not the content is personal or relates to government.

"They came out and they announced it and I think he's helped a little bit to repair the damage [Comey has] done. But the basic damage is that the FBI should be the silent investigative branch of the government. We should never hear from them. We shouldn't even know anything about their internal behavior."

Dershowitz said that any and all information about criminal probes should come from one source and one source only — the Justice Department.

"Comey was wrong in July. He should never even have announced that they weren't prosecuting Hillary Clinton … The Justice Department should've made whatever announcement it wanted to make," he said.

"And then he shouldn't have made the 10 days ago announcement. Unfortunately, he was compelled to make this announcement."

There have been news reports that an anti-Clinton faction within the FBI has been behind the leaks.
