Nunes: Comey Not In Clear Even If DOJ Isn't Prosecuting Him

Even if the Department of Justice has decided not to prosecute former FBI Director James Comey after an inspector general's report revealed he'd created and leaked memos of his conversations with President Donald Trump to spur special counsel Robert Mueller's investigation, he's not in the clear, Rep. Devin Nunes said Tuesday. 

"It is a tremendous amount of evidence that we would build into the case that we have been making, that there was, in fact, a conspiracy, and that is what the Justice Department should be looking at," the California Republican and ranking member on the House Judiciary Committee told Fox News' "America's Newsroom."

"I have to remind the audience that at the House Intelligence Committee, Republicans, we sent over eight criminal referrals," said Nunes. "It's taking you back to when James Comey testified before Congress. He writes a lot in (his) book, talks to the media, but when he answers the question to Congress, he didn't answer very many questions. He couldn't recall. There was a lot left there."

Nunes added that a full examination of the investigators involved in the probe of President Donald Trump has been ordered. 

"The Mueller report that came out, even though it exonerated Donald Trump, it really didn't answer the very basic questions that we have been looking at as House Republicans," said Nunes. "Who are all of these characters that started this investigation? How did this begin?"

Comey "pretended" he wasn't involved, said it turns out he was "actually interrogating the president," said Nunes. "He was using that information and feeding it right back into the crossfire hurricane team at a time when congress nor the president-elect knew that he was under investigation."
