Special Counsel Robert Mueller asked for more time to consider whether to retry President Donald Trump’s former campaign chairman Paul Manafort on the 10 counts that a Virginia jury couldn’t decide last week.

Mueller filed the request to postpone the Wednesday deadline to U.S. District Judge T.S. Ellis III, saying his team didn’t have sufficient information to make the decision because Manafort’s lawyers hadn’t filed the post-trial motions.

“The United States has consulted with counsel for the defendant and they do not object to the government’s motion,” Mueller’s team said in the filing.

Manafort was found guilty on Aug. 21 of five counts of filing false tax returns, two counts of bank fraud and one count of failing to report a foreign bank account. He faces another trial next month in Washington on a separate set of charges, focused on allegations of money laundering, failing to register as a foreign agent while he was working for a Ukrainian political party, and obstructing justice.
