Court Battle Looms in Outcome of NY House Race

RIVERHEAD, N.Y. (AP) — A Democratic congressman trailing in a bid for a fifth term is heading to court to seek an election recount in New York's First Congressional District on eastern Long Island.

Timothy Bishop appeared to have about a 3,400-vote lead on Nov. 2, but a review by the Suffolk County Board of Elections found several reporting errors that resulted in a 383-vote lead for Republican Randy Altschuler. A board commissioner declined comment Tuesday.

Bishop's camp has said that because the outcome is now so close, all 184,000-plus ballots cast should be recounted. There are also over 10,000 uncounted absentee ballots.

Bishop's lawyers are going to state Supreme Court in Riverhead on Tuesday afternoon.

An Altschuler spokesman did not immediately comment.
