Jay Sekulow on Thursday suggested that the current situation with Mike Flynn’s court case is repetitive of 2017 when special counsel Robert Mueller was brought in to handle the Russia collusion investigation.
“Here we go again,” Sekulow said Thursday during an appearance on Newsmax TV’s “Spicer & Co.” in reference to D.C. Circuit Court Judge Emmett Sullivan announcing that he would hear from a federal judge-turned-private-attorney about why he shouldn't dismiss the Flynn case and whether he should hold Flynn in criminal contempt for perjury.
“They’re trying to now get that General Flynn made a false statement in his plea because he said he did it when he didn’t do it,” Sekulow added.
Flynn, who briefly served as Trump’s national security adviser in early 2017 before resigning after reports he had misled Vice President Mike Pence about his phone calls with Russia’s ambassador, withdrew his original guilty plea for lying to the FBI on Jan. 14.
The Department of Justice last week dropped Flynn’s case, saying the “Government has determined, pursuant to the Principles of Federal Prosecution and based on an extensive review and careful consideration of the circumstances, that continued prosecution of this case would not serve the interests of justice.”
Sullivan a few days later named retired federal judge John Gleeson to present "arguments in opposition to the government's motion to dismiss" the matter.
“This judge 27 times said no outside groups filing briefs on behalf of against General Flynn. I’m not going to allow it,” said Sekulow. “Not going to have it happen. He then appoints his own friend of the court to do exactly what he said would not be appropriate in a criminal case and says he has the inherent power to do it as a district court judge. I don’t believe he does – at all.”
