Rep. Eric Swalwell, D-Calif., argued Thursday that House Speaker Nancy Pelosi, D-Calif., was right in not immediately forwarding the impeachment articles to the Senate for trial because "we don't want a predetermined rigged outcome."

Swalwell, a member of the House Judiciary and Intelligence committees, told Fox News host Harris Faulkner that Senate Majority Leader Mitch McConnell, R-Ky., was "not representing fairness, because he is admitting that he is anything but impartial.

"He is working with the president's lawyers, which is akin to a prosecutor working with the foreperson of a jury."

McConnell has said that would work with the White House during the trial — and the majority leader this week rejected a Democratic outline that proposed calling four witnesses, including former National Security Adviser John Bolton and acting White House chief of staff Mick Mulvaney.

"Speaker Pelosi is saying that if she's going to send these managers over and these articles over, we don't want a predetermined rigged outcome," Swalwell said.

The fourth-term congressman also dismissed Republican concerns that Democrats were objecting because Republicans could call Intelligence Committee Chairman Adam Schiff or former Vice President Joe Biden for testimony in a trial.

"She's spoken to a fair trial," Swalwell said of Pelosi, also D-Calif.

"Trials do have witnesses — and I thought it was interesting that in 1999 Sen. McConnell went on another television network [CNN] and said, as it relates to the Clinton impeachment trial, that the Senate trial then should have witnesses.

"He said trials have witnesses," Swalwell added.

"He should follow the advice he gave then, because it was right then and it's true now."
