Former FBI director James Comey could soon be charged with a federal crime stemming from his interactions with President Donald Trump, Bill O'Reilly told Newsmax TV.

"I don't think anybody believes Comey now," O'Reilly told "The Wayne Allyn Root Show." "When he said last week he didn't remember more than 200 times, nobody believes that.

"Comey doesn't want to be charged with perjury. I think he's gonna be charged with leaking government documents. He's already admitted doing that, I think that'll come next year."

For the second time this month, Comey on Monday spent time on Capitol Hill answering questions from lawmakers probing his role and actions surrounding the Hillary Clinton email case and the early days of the Russia investigation.

O'Reilly said Comey likely did not say much during his most recent hearing, as was the case in the first one.

"He doesn't want to compound his criminal exposure," O'Reilly said. "Comey knows a lot, but I do not expect him to be candid in these hearings in front of the Senate committee."

Regarding the case surrounding former National Security Adviser Michael Flynn, O'Reilly thinks it is possible the retired Army lieutenant general could have his entire case thrown out. He is due to be sentenced on one count of lying to the FBI on Tuesday.

"I think there's a one in three chance the judge throws it out," O'Reilly said. "It's not [special counsel Robert] Mueller who set up Flynn, it was Comey. It was the FBI that did it. So, the judge knows that, and he knows that Flynn was under financial pressure having to pay all the legal bills. He  could throw it out."
