The Justice Department's disclosure to a federal judge Thursday that Hillary Clinton broke no laws in using a private email account was merely a response to "a phony charge, a strawman" political analyst Dick Morris told
Newsmax TV.
"Nobody is saying that the maintenance of a server by itself was illegal," Morris told "The Hard Line" host Ed Berliner. "All we're saying is that if you have your own server and there are classified materials that flow into it, remain on it, and are sent from it, you are violating the law just as much as [retired Army Gen. David] Petraeus was when he put them in his desk drawer."

"There are now over 100 emails that, when they were released, had to be redacted because there's so much sensitive material on them that have come from Hillary's server," he added. "That's the legal jeopardy she's in, not that she had the server."
Morris is the co-author of The New York Times best-seller,
"Power Grab: Obama's Dangerous Plan for a One-Party Nation."
The email controversy, and Clinton's response to it, are key to the Democratic front-runner's falling poll numbers against challenger Vermont Sen. Bernie Sanders — even Vice President Joe Biden.
"In the last national poll, she gets 42 percent of the vote," Morris said, referring to the
Monmouth University poll released on Tuesday. "She had formerly been getting in 67, 68."
"That means that 58 percent of the Democratic primary voters are voting against her, 22 percent for Sanders, 20 for Biden — and the rest undecided or for one of the other candidates."
"That's a huge reversal for her and puts her in very bad shape."
