Legal Analyst: If Bergdahl Discharged, Army Loses Right to Court Martial

Criminal defense attorney Michelle Suskauer joins John Bachman on "America's Forum" on Newsmax TV on Wednesday discuss the latest developments in the Boston Marathon bomber trial and news that former Taliban captive Sgt. Bowe Bergdahl has been put on active duty.

"If he gets discharged, they're going to lose jurisdiction over him, if they eventually want to have a court martial," Suksauer explained. "At this point, he has not been questioned. He is under scrutiny, and he has retained a civilian attorney because he will be questioned."
