Treasury and IRS to Miss Trump Tax Return Subpoena Deadline

The Treasury Department and the Internal Revenue Service are expected to miss the deadline to turn over President Donald Trump’s tax returns to congressional Democrats, The Hill reports.

The House Ways and Means Committee subpoenaed the treasury secretary and IRS commissioner earlier this month for Trump’s tax returns from the last six years, following a request made to Treasury Secretary Steven Mnuchin in early April. Democrats cite a provision of the tax code that dates back to the 1920’s, which states that the treasury secretary “shall furnish” tax information to Congress when requested.

“I think Friday is the turning point,” Rep. Bill Pascrell, D-N.J., told the Hill. “There’s no more letters to be written.”

A spokesperson for House Ways and Means Committee Chairman Richard Neal, D-Mass., told the Hill: “Our request is in furtherance of the committee’s investigation into the mandatory presidential audit program and to decide whether that program needs to be codified into federal law. This is part of our oversight over the IRS.”

In testimony earlier this week, Mnuchin claimed that Democrats were “weaponizing the IRS” in their fight for Trump’s tax returns, and implied that the courts could end up making the final decision.

"First of all, we haven't made a decision, but I think you can guess which way we are leaning on our subpoena," Mnuchin said Wednesday, according to ABC News. "To the extent that we don't and there is litigation, I take great comfort that there's a third branch of government to deal with this important issue."
