President Donald Trump "understands what a real problem" the asylum process is, and his proposal to stop people from claims that get them automatic admission into the United States is the right step, Rep. Andy Biggs said Friday.
"We have one in 10 people coming into this country claiming asylum and something like 80 percent of them are making false asylum claims," the Arizona Republican told Fox News' "America's Newsroom." "It's a ruse, a hole in our law...we have to stop it."
He also called claims that the 5th Amendment justifies the right to come into the United States "bogus."
"If you're not in this country, you don't have any constitutional right protections, if you're not a citizen and not here legally," said Biggs. "They say if you put one foot in the country, you have some kind of massive amount of legal rights, a bundle of rights they'll protect. I don't ascribe to that."
Biggs said there will most likely be a court challenge against Trump's decision, and he expects an avalanche of such lawsuits to be filed in the U.S. Court of Appeals 9th Circuit in California.
He also said he thinks the asylum process is the "prototype" for the catch and release issue in the United States.
"The courts have said you can't hold (people) more than 20 days," said Biggs. "We're giving tickets to show back up in court and only about 2 percent of people ever come back to appear with those courts. They come in, claim asylum and they're released all over the country."
