Sapp: End Liberal Judicial Activism With Four More Years of Trump

In 1821 Thomas Jefferson confided in Virginia Supreme Court Justice, Spencer Roane, one of his greatest fears for future generations of America, "The great object of my fear is the federal judiciary." In similar style Jefferson wrote to Roane in 1819 of his great concern in the reliance upon the Supreme Court to be the ultimate arbiter of the Constitution.

Jefferson explained to bestow this kind of power upon these unelected civil officers would be to transform the Constitution into "a mere thing of wax in the hands of the judiciary, which they may twist and shape into any form they please."

Isn’t that exactly what is happening in America today through activist judges?

In spite of Jefferson’s warnings, his nightmare vision of the federal judiciary has become the dream of liberal politicians and professors in America today. In our current judicial world, judges rule by political ideologies and personal attachments, shunning constitutionally sound principles.

Now, more than ever it's critically important to have a president who will nominate federal judges who will restore America to its proper constitutional standards.

It's time for the era of socially accepted judicial activism to end and President Donald Trump has already begun making that change.

As of Feb. 27, 2020, President Trump has nominated, and the U.S. Senate has appointed, 205 federal judges and two Supreme Court justices. President Trump is putting a huge dent in the 341 liberal federal judges and two activist Supreme Court justices appointed by Barack Obama during his two terms.

It's important to make sure the trend of nominating constitutional judges continues.

There are nearly 100 federal judge vacancies currently unfilled and there will be even more in the next six years. We can also be sure that the president elected in 2020 will make at least one Supreme Court appointment.

We cannot let that key responsibility fall to a Democratic president who has actually promised to fill judicial vacancies with liberal agenda driven appointments.

We are entering into a new season of Supreme Court activity that would give liberal activist justices the opportunity to vastly reshape the face of America.

For example, in this next judicial term, the Supreme Court will hear seven constitutionally important cases. In 2020 the Court will hand down their opinion on a landmark separation of powers case. This court could determine whether we have a Congress limited to the laws of due process or one virtually unlimited in power which issues subpoenas for the personal records of a president without criminal charges.

The 2020 U.S. Supreme Court will also hear cases involving questions of religious liberties, two cases that will set a precedent in the protection of private business property, and one case that has the potential to restore power to the states to protect and defend the lives of the unborn.

We can only hypothesize on the future of cases that will be presented to the court.

However, rest assured, in light of the debate over Second Amendment rights and the ongoing battle on college campuses to ensure the free speech rights of conservative students, future cases before the federal courts will hold similar, if not greater importance for the protection of our most fundamental rights. Can you imagine what would happen in these cases with a Supreme Court majority built upon the ideologies of liberal activist judges?

We need federal judges who want to defend life — not destroy it.

We need a president who will appoint judges who want to secure the right of the people to keep and bear arms, not control it. We want justices on the Supreme Court who respect the sacred nature of our conscience, defending the religious liberty of all people; not forcing agenda driven ideologies upon Americans contrary to their beliefs.

Those who ratified our Constitution, creating the terms and conditions upon which federal judges hold office, would be angered at the level of judicial activism infecting our federal courts.

Alexander Hamilton remarked in "Federalist 83," that judges who substituted "their own pleasure" over the standard of the Constitution should be considered repugnant and impeached without hesitation. It's important to know we have a president who will replace these repugnant judges with men and women who will uphold constitutional principles and not give in to their own ideological "pleasures."

There ought to be no doubt that the Democratic candidates for president coming forward for the 2020 election will actively seek candidates to push their liberal, socialist agendas in order to further transform America into a post-constitutional society. We cannot let that happen. Now more than ever we need President Donald Trump.

Mr. Trump has proven he has the courage and discernment to select judges who put the American people and our Constitution first.

Liberal activist judges are eroding the very fabric of America, creating a legal reality that our Founders would only recognize as the tyranny they fought to escape.

Re-electing our current president will ensure that we have another four years of opportunity to end the reign of liberal activist judges — making America’s judiciary great again.
