Nevada Gun Laws: Can Towns and Cities Make Local Rules?

There is statewide pre-emption of most gun laws in Nevada. On the local level, municipalities are authorized under state law to regulate the unsafe discharge of firearms.

According to Armsinfo.com, the preemption laws are as follows:
  • Counties may not infringe the right of the legislature
  • Cities may not infringe the right of the legislature
  • Towns may not infringe the right of the legislature
  • State parks may not create more restrictive firearm possession rules or self-defense rules.
State pre-emption law does not apply to federal lands.

According to Nevada law, regulations state that the legislature reserves the right to oversee the transfer, sale, purchase, possession, ownership, transportation, registration, and licensing of firearms and ammunition, and that no county, city, or town respectively may infringe upon these rights.

The laws specifically allow municipalities to regulate the unsafe discharge of firearms, and they permit Clark County to maintain handgun registration. Clark County emcompasses Las Vegas. It’s important to note that someone must be in Clark County for 60 days before registration is required. Also, the Nevada Division of State Parks may not enforce regulations more restrictive than the state law with regards to firearm possession and self-defense.

It is important to note that these pre-emption laws are specific to firearms only, and not other weapons such as knives, meaning that local governments are able to create their own restrictions for weapons other than firearms.
