NYC Judge to Rule On Tossing Letterman Extort Case

Tuesday, 19 January 2010 08:58 AM EST

A television producer accused of blackmailing David Letterman over the late-night comic's love life is set to find out whether a New York City court will toss out the criminal case against him.

A Manhattan judge is expected to rule Tuesday on Robert "Joe" Halderman's bid to get an attempted grand larceny charge dismissed.

Prosecutors say Halderman demanded $2 million to keep quiet about the CBS "Late Show" host's affairs with staffers. Halderman says he just offered Letterman a chance to buy a thinly veiled screenplay about his life and keep it private.

The case spurred Letterman to tell viewers in October he'd had sex with women who worked for him.

The 52-year-old Halderman could face up to 15 years in prison if convicted.
