Family Awarded $90M in Death of Daughter on Her Way to School

The family of a teen who was hit by a car and killed on her walk to the bus stop in 2009 has been awarded $90 million in a wrongful death suit against a Maryland school board.

A six-person jury awarded the family of 13-year-old Ashley Davis $90 million in damages earlier this month, ruling that the Prince George's County Board of Education was at fault for Davis' 2009 death.

Ashley Davis was hit by a Lincoln Continental as she crossed the street to get to her bus stop in September 2009. The car also struck a minivan and a 17-year-old boy. Davis, who had been a freshman at Crossland High School, suffered devastating injuries and died two weeks later.

"She was on her way, she was going to school, she was a good girl, she didn’t deserve this," her mother, Nycole Davis, told NBC Washington. "If she didn’t have to cross the street, she'd be graduating this year, she'd be going to prom this year."

In their lawsuit, the family alleges that the school did not provide the girl with safe and adequate transportation.

"The school board was negligent," John Costello, the Davis family's lawyer, told NBC Washington. "They had adopted a policy to provide for safe transportation. The policy was they were going to pick up Ashley on her own side of the street. They never did. They forced her to cross the street. She got killed crossing the street."

In addition to the hefty settlement, the Davis family will also have their daughter's medical expenses and funeral costs covered.

"I didn’t ask anyone to give me any money or anything like that," Nycole Davis told NBC Washington. "I just want someone held responsible for what happened to my daughter."

The school system is expected to appeal the decision, Costello said.
