The long-running trademark battle of Dr. Dre vs. Dr. Drai — the rapper versus a gynecologist — has been decided. Dr. Dre lost.
The brouhaha began three years when Pennsylvania-based OB-GYN and author Dr. Draion M. Burch attempted to trademark his nickname, “Dr. Drai.”
The rapper and producer Andre Young who uses the stage name “Dr. Dre” objected, stating that the two similar-sounding names might cause "confusion" and a "suggestion of a connection" between the two.
The OB-GYN disagreed.
"It is not likely that consumers will recognize Applicant’s Dr. Drai’s marks as referring to Dr. Dre because Dr. Dre is not a medical doctor nor is he qualified to provide any type of medical services or sell products specifically in the medical or healthcare industry," Burch said, BuzzFeed reported.
The rapper is known for the album "The Chronic;" the physician is known for books such as "20 Things You May Not Know About the Vagina."
The medical doctor testified that not only is it unlikely his name would be connected with that of the rapper, but that he also doesn’t want any such connection.
"Being an OB-GYN, I cannot be associated with anyone that has any kind of misogynistic speech because it’s a bad reflection on me as a doctor,” he said, BuzzFeed reported
But what was perhaps the physician’s best argument was also the simplest and most obvious: “That’s my name.”
The official ruling came out in Dr. Burch’s favor because the rapper "failed to show a connection" between the businesses of two parties, BuzzFeed reported.
The story caused something of a stir on social media.
