A sexual assault case against Texas church gunman Devin Patrick Kelley was dropped in 2013 after the alleged victim stopped cooperating with officers, new reports detail.
The incident was reported in June of 2013 when a woman accused Kelley of holding her down and forcing her to perform a sexual act on him after she refused, KSAT reported.
The woman reported the alleged assault to police the next day. At the time, Kelley had already been court martialed for physically abusing his wife and fracturing the skull of her young son, and Kelley’s wife had divorced him, KSAT reported.
Kelley’s ex-wife Tessa Brennaman was an outcry witness for the alleged victim in the 2013 assault, whose name was redacted in all of the police documents, KSAT reported. Brennaman said she was told about the assault the day after it took place.
The investigation stalled out, however, when the alleged victim didn’t respond to police attempts to speak with her, including three voicemails and a letter, KSAT reported.
The woman had signed a complaint agreement to press charges against Kelley prior to cutting off contact with police, The Associated Press reported.
Brennaman has said Kelley repeatedly slapped and choked her during their marriage, even “water-boarding” her before their divorce in 2012, the AP reported.
The Air Force acknowledge that it failed to report Kelley’s court-martial to the FBI, which might have prevented Kelley from legally obtaining a gun, the AP noted.
Kelley also was charged with cruelty to animals in 2014 for repeatedly beating his dog and tying it up outside without water when he lived in Colorado, The New York Times reported.
