Man Pleads Guilty to Cocaine Possession – But 'Drug' Was Powdered Milk

Cody Gregg, a homeless man in Oklahoma, sat in prison since August facing charges of cocaine possession. Last week he finally pleaded guilty and was sentenced to 15 years in prison. But in a unique turn of events, he found himself back in court two days later, this time to withdraw his guilty plea.

It turns out that the suspicious white substance recovered from his bag just before his arrest was not cocaine but powdered milk.

The reason why Gregg, 26, entered his guilty plea was to get out of the Oklahoma County jail, according to The Oklahoman. He was arrested on Aug. 21 last year after he fled police who had tried to stop him while riding his bicycle through downtown.

He "started to pedal harder as if he was trying to get away," an officer reported in a probable cause affidavit. After three blocks Gregg ditched the bike and tried to flee on foot.

When the officers did catch up to him, they demanded to search his backpack. Inside they discovered a coffee can filled with a white powder. Suspecting that the substance was cocaine, police arrested and charged Gregg with a felony.

"Inside the baggie was a large amount of white powder substance that I believed to be cocaine based on my training and experience," the unnamed arresting officer stated in the affidavit. "The white powder inside the baggy later tested positive for cocaine and was a total package weight of 45.91 grams of cocaine."

However, lab results that came back last week showed that the white substance was actually powdered milk. The case was dismissed on Thursday and Gregg was released the following day, according to jail records.
