A "kill gays" ballot initiative in California that would require anyone participating in same-sex sexual relations be killed “by bullets to the head” or other methods would likely be unconstitutional should it pass, but one state leader is trying to get it stopped now.

State Attorney General Kamala Harris on Wednesday asked a Sacramento court to allow her office to reject the proposed ballot initiative, being called the Sodomite Suppression Act.

If she is not allowed to stop the initiative, Harris' office will be forced to give the sponsor, attorney Matthew McLaughlin, the permission to seek 366,000 votes that would be needed to put it on the ballot in November 2016.

The proposed initiative, along with making it punishable by death to have sex with someone of the same gender, also would make it illegal to distribute gay “propaganda,” punishable by $1 million fines or banishment from California.

“Attorney General Kamala Harris is doing the right thing by asking the court to allow California to reject an obviously unconstitutional and dangerous initiative proposal that actually promotes murder,” the Times of San Diego quoted assembly speaker Toni Atkins, who is lesbian. “The proposal represents either the depth of bigotry and hatred or the height of sick publicity stunts — either way it should not be dignified by becoming an official part of the process Californians have to amend the state Constitution.”

Since McLaughlin put forth the proposed ballot initiative, horrified reactions to the idea have dominated the Internet.
