In one case, the plaintiff is a Seminole County voter – and Democrat – Harry Jacobs. He contends that all 15,000 absentee ballots cast in Seminole County should be thrown out because GOP workers were allowed to add voter ID numbers to the absentee ballot applications.

This would run counter to the explicit language of Florida law regarding these applications: Only the voter, a family member or a ‘legal guardian’ can fill out these applications.

The judge in this case is Judge Nikki Ann Clark, a black woman who used to be a Legal Services lawyer (they are usually very liberal) and whom Gov. Jeb Bush recently passed over for a promotion to a higher appeals court.

Team Gore has been secretly hoping that Judge Clark will be their secret weapon.

Down the hall an almost identical case will be heard by Judge Terry Lewis regarding absentee ballot applications in Martin County. Like Seminole, this case is also brought by voters – and Team Gore is not a party to the case. (Judge Lewis is the conservative Democrat who upheld Secretary of State Katherine Harris’ Nov. 14 certification.)

The key here is the

If so – pending immediate appeals – Gore would surge ahead by several thousand votes in Florida.

Yes, the (liberal) Florida Supreme Court would be the final arbiter of an appeal on these two cases. The U.S. Supreme Court does not have jurisdiction over these absentee ballot cases.
