Sasse Predicts Texas Lawsuit Will Fail

The lawsuit filed by the Texas attorney general at the Supreme Court will be dismissed, Nebraska Sen. Ben Sasse said Thursday.

"I suspect the Supreme Court swats this away," Sasse told the Washington Examiner.

Texas Attorney General Ken Paxton filed suit against four battleground states lost by President Donald Trump. Paxton claims election results in Georgia, Pennsylvania, Michigan and Wisconsin were inaccurate due to unconstitutional and late changes to the election process.

Sasse added the lawsuit, in which Paxton said the four states "tainted the integrity" of the presidential election with mail-in ballots, did not break new ground in election litigation.

“Its assertations have already been rejected by federal courts and Texas' own solicitor general isn't signing on," Sasse said.

The senator added it appeared Paxton filed a "PR stunt rather than a lawsuit," in an attempt to gain "a pardon" from President Trump.

Paxton currently is the subject of an FBI investigation for allegedly using his office to benefit an Austin real estate developer.

The Supreme Court requested legal representatives for the four states to respond by Thursday afternoon. Texas then can reply, before the court rules.
