A federal judge in Philadelphia appeared skeptical of a Republican lawsuit that is trying to invalidate nearly 100 mail-in ballots from the election.
According to Politico, U.S. District Court Judge Timothy Savage heard arguments from Republicans regarding their claim that 93 ballots are tainted and should not be counted because election officials gave the voters who filled them out an opportunity to fix, or "cure," problems with them. Those problems included mistakes made in filling out the ballots or not signing them.
"I'm not sure about that," Savage said. "Is that exactly what was said or is what was said was that there is no mandatory requirement that the election board do that?
"Wasn't the legislative intent of the statute we are talking about to franchise, not disenfranchise, voters?"
Attorney Thomas Breth replied, "This isn't disenfranchising voters. They can't do this unless the election code provides them the authority to do this."
Lee Soltysiak, the chief operating officer of Montgomery County, said at the hearing that he believes as many as 93 ballots were affected. They are currently in a locked cabinet that's under constant surveillance.
Pennsylvania is one of several battleground states that have yet to determine who won the election.
