The race for New York’s 22nd Congressional District is no longer certain after officials found 55 previously uncounted ballots, according to an attorney from Chenango County.
Republican candidate Claudia Tenney held just a 12-vote lead over Democrat Rep. Anthony Brindisi in a vote count on Monday, which was the last day to report vote totals. However, attorney Alan Gordon informed New York Supreme Court Justice Scott DelConte on Tuesday that a few dozen ballots cast during the district’s early voting period had been found.
“Those ballots were apparently mislaid and never counted,” Gordon wrote, according to National Review.
“I have advised our Board of Elections to not open any of those ballots and to secure them in their offices,” he added.
“My guess is they came in early and they were put aside and mislaid,” Gordon told Syracuse.com, noting that county election officials hadn’t shared any additional details with him.
“I would hope that we could open them tomorrow with representatives present from each campaign,” he said.
Chenango County Elections Commissioner Carol Franklin told Syracuse.com that all of the uncounted ballots were affidavit ballots that were submitted during the early voting period in the state, but she said she could not explain why they weren’t counted initially.
