Matthew Whitaker to Newsmax: SCOTUS Will Rule Unanimously on Ballot Appeal

Matthew Whitaker, acting Attorney General in the Trump administration, told Newsmax on Wednesday he can't imagine that the U.S. Supreme Court, even its most liberal members, won't unanimously strike down the Colorado Supreme Court's ruling that Donald Trump is ineligible for that state's Republican primary ballot.

The U.S. Supreme Court is soon expected to rule on an appeal to the Colorado high court's decision, which kicked Trump off the state's GOP primary ballot, citing Section 3 of the Fourteenth Amendment, which disqualifies from office those who engage in insurrection against the Constitution after taking an oath to support it.

The court cited Trump's alleged involvement in the events of Jan. 6, 2021, but Trump has never been charged with insurrection and has denied any responsibility for the day's events.

"Donald Trump has not been charged with it nor has anybody that participated in the January 6th riot, and you put all that together, and I just can't imagine that one Supreme Court justice, no matter how radical left they might be, is going to [be so biased]," Whitaker said on American Agenda.

Whitaker said any justice who upholds the Colorado decision will be acting like Maine Secretary of State Shenna Bellows, who excluded Trump from that state's primary ballot citing Section 3 of the Fourteenth Amendment.

Whitaker said the Colorado case is best suited for the U.S. Supreme Court to rule in favor of Trump and end any further attempts to keep him off other state primary ballots.

"I think the Supreme Court could smack it down pretty easily because all of the arguments that the Supreme Court of Colorado got wrong are teed up for the U.S. Supreme Court," he said. "Many people that watched the U.S. Supreme Court are saying, and I agree, that they're going to try to find a way to unanimously reject this Colorado court case and allow President Trump to ultimately be voted for or against by the American people, which is the way the way it should be."
