Democrat attorney Marc Elias is claiming that a faulty tabulation of votes marred an upstate New York congressional race.
Elias made his claims in court papers filed on Monday. The case focuses on the race between Republican Claudia Tenney and incumbent Democrat Anthony Brindisi, according to Breitbart News. Elias is representing Brindisi, who is trailing by 123 votes.
Elias was one of those who helped lead efforts to overturn constraints on mail voting during the November election.
“The General Election for the public office of member of Congress, 22nd District of New York occurred on November 3, 2020,” said Elias’ law firm in court papers filed Monday and posted by Democracy Docket. "Since then, substantial errors and irregularities in the conduct of the election have come to light,”
“As these proceedings have continued, that evidence has only mounted.
“… there has also been mounting evidence of significant irregularities in the tabulation of ballots. These errors and irregularities threaten to deny the voters the election of their candidate of choice. As a result, a hand audit is warranted under New York law and should be immediately ordered.”
Tenney has already declared victory in the race.
”It's time for Anthony Brindisi's Washington operatives to accept the results and stop playing politics with the integrity of our elections,” her campaign spokesperson noted.
