President Donald Trump likely will not be interviewed by special counsel Robert Mueller, and there will probably be a draw in the Supreme Court about the kinds of questions the president can face, Harvard Law Professor emeritus Alan Dershowitz said Thursday.
"I think in the end there will be no sit-down," Dershowitz told Fox News' "America's Newsroom."
"President Trump will get on television and say, 'I wanted to sit down, but Mueller wouldn't come up with terms that were acceptable to my legal team.'"
If that happens, Mueller will go to court for a subpoena on Trump, and "we're battling for probably a year," he predicted. "I think the Supreme Court will allow certain questions to go forward but not allow others, and that will be a year or so from now."
Trump's attorney, Rudy Giuliani, told Fox's Sean Hannity Wednesday that Mueller's team represents a "different kind of Watergate" and called it "corrupt," but Dershowitz said he considers him a "fine law enforcement official."
He did admit that the former FBI director has always had a reputation for being an "overzealous prosecutor."
"You prosecute to the hilt a man like [Paul] Manafort for crimes unrelated to the scope of the investigation because you want to squeeze him," said Dershowitz. "Those are tactics that civil libertarians like me have opposed for 50 years."
However, other libertarians are silent because Trump is the object of the probe, and they "abhor him," Dershowitz added, but he disagrees.
"I'm refusing to apply a different standard to Donald Trump than I would to Hillary Clinton," he said.
