Former CIA Director John Brennan won't follow through on his threats of a lawsuit against President Donald Trump over losing his security clearance, as he won't want to be cross-examined, Harvard Law professor emeritus Alan Dershowitz said Monday.
"Brennan is the worst person to bring this lawsuit," Dershowitz told Fox Business' "Mornings With Maria" host Maria Bartiromo. "He has said things that, had he said them as the director of CIA, would have resulted in his security clearance being revoked. He is not going to bring a lawsuit. He doesn't want to be cross-examined. He has the weakest of cases."
Dershowitz said he does believe the matter of security clearances should be handled through a nonpartisan board established by the State and Defense departments to determine when former employees should be maintained by former employees.
"You might say all security clearances be removed as soon as a person leaves office," said Dershowitz. "They would have to selectively apply and show a need. That would make sense."
The law professor also defended Trump attorney Rudy Giuliani for his "truth isn't truth" comment on Sunday, saying the former New York City mayor was correct from a legal stance.
"You never allow your client to answer a question truthfully if someone else will answer differently," said Dershowitz. "That is what Rudy was trying to say, inartfully, but the point was something every defense attorney would agree to."
