Senate Intelligence Committee Chair Dianne Feinstein is straddling the fence on the issue of torture, says former New Jersey Superior Court Judge Andrew Napolitano.
"She is being disingenuous and profoundly intellectually dishonest," Napolitano, chief judicial analyst for Fox News, told "The Steve Malzberg Show" on Newsmax TV.

Feinstein wants parts of the Senate’s report on Bush-era interrogation methods to be made public to "ensure that an un-American, brutal program of detention and interrogation will never again be considered or permitted."
Her committee recently voted to declassify 500 pages of a 6,300-page study that reportedly concludes that torture by CIA operatives has not worked in the war on terror.
"She is basically saying, 'I approve of torture as long as I know about it ahead of time. I approve of spying as long as I approve it and you don't spy on me,"' Napolitano said Monday.
"'I even approve of the president killing whoever he wants as long as he gets permission from me first. But if you do this without telling me about it, then I come down on you.' Well, what the heck kind of a government is that?"
Napolitano said that while parts of the report will remain secret, "I imagine that there will be a big brouhaha against George W. Bush and there will be a big dispute over whether or not these harsh methods of interrogation, which I call torture . . . [will] actually save the republic."
