Andrew McCarthy: Give Lerner Immunity in IRS Probe

Former IRS official Lois Lerner should be granted immunity from prosecution to spill what she knows about the agency's targeting of conservative groups, former federal prosecutor Andrew McCarthy says.

"The idea of immunity is it extinguishes your Fifth Amendment privileges," McCarthy told "The Steve Malzberg Show'' on Newsmax TV.

Lerner has been held in contempt of court for professing to be innocent of any wrongdoing and then refusing to answer questions on Capitol Hill, claiming her Fifth Amendment rights against self-incrimination.

She has indicated a willingness to testify in exchange for immunity.

"The statute of limitations on perjury and obstruction of justice is five years. The Obama-Holder Justice Department is not going to be in power for five years," McCarthy said.

"So she will know that she has criminal exposure, and that it's very likely at some point in time she be prosecuted if she obstructed or committed perjury. It's more than likely she'd testify."

On first lady Michelle Obama stating the kidnapping of nearly 300 schoolgirls in Nigeria by the Islamic extremist group Boko Haram is all about stopping girls from getting an education, McCarthy calls it "preposterous."

"They are a group that has been in cahoots with al-Qaida for a long time. There's some intelligence that suggests that they got seed money at the beginning of their existence from Osama bin Laden," said McCarthy, a former Assistant U.S. Attorney for the Southern District of New York. "This is clearly a terrorist organization. It's not even close. And in fact, the Obama State Department did ultimately list them as a terrorist organization."
