Former New York City Police Commissioner Bernard Kerik told Newsmax TV on Wednesday that reports that Deputy Attorney General Rod Rosenstein threatened to subpoena Russia probe documents from a congressional committee proved "he's accountable to nobody."

"As long as Bob Mueller is the special counsel, Rod Rosenstein is above the law," Kerik, who oversaw the city's forces during the 9/11 attacks, told "Newsmax Now" host John Bachman. "He's accountable to nobody."

Attorney General Jeff Sessions told Fox News on Tuesday that reports involving Rosenstein and the House Intelligence Committee were a "mischaracterization" of what occurred between the parties in a January meeting.

"I'm confident that Deputy Rosenstein, after 28 years in the Department of Justice, did not improperly threaten anyone on that occasion," Sessions told Fox News host Tucker Carlson.

The Intelligence panel is headed by Republican Rep. Devin Nunes of California.

However, Kerik told Bachman that Rosenstein has so much power because "the attorney general is nowhere to be found.

"He's recused himself and Rosenstein can do whatever he pleases.

"That's what we're seeing.

"If that's not the case," Kerik added, then the Justice Department "should produce the documents requested by Congress and let Congress do its job."
