Wisconsin Sen. Ron Johnson says he's "optimistic" about the lawsuit he filed against the White House over the special treatment Congress was given by President Barack Obama under Obamacare, granting lawmakers "a tax-free employer contribution" toward their health insurance.
A
hearing was held Monday with a federal judge in Green Bay, Wis., to address the government's motion to have the lawsuit dismissed.
Johnson told J.D. Hayworth on "America's Forum" on
Newsmax TV on Wednesday that he was encouraged by "the way this judge has given this case the serious consideration it deserves," adding that he believes "we've got a good case, and I'm optimistic."

"The Congress very explicitly wanted to put ourselves in the same position of every other American when we buy our insurance through the exchange," he explained.
"President Obama, without the legal authority, granted us special treatment," he said. "We're the only people in America that when we buy our policies through the exchange we get a tax-preferred, tax-free employer contribution. That's unfair."
"That's not equal treatment under the law," he said. "It needs to be overturned."
