Michael Cutler: Supreme Court Will Rule on Executive Amnesty

The federal judge who said that President Barack Obama's executive immigration order is unconstitutional is right, and the issue will likely end up at the Supreme Court, says former Immigration and Naturalization Service officer Michael Cutler.

"You can't give millions of people the authority to remain in the country where there's no legal justification for it," Cutler told J.D. Hayworth on "America's Forum" on Newsmax TV on Wednesday.

A Pennsylvania federal judge rejected the Obama administration's legal reasoning in defense of the president's executive actions over immigration, saying they are unconstitutional because he violated "the separation of powers."

"The judge is right," Cutler said.

"The administration will probably take this all the way to the Supreme Court," he contends.

"Every day that the nonsense continues, more illegal aliens pour into the United States, drawn here, in part, by the promises of the administration and failures to act to enforce the law," he explained.

The former INS agent says the most concerning part of the recent news that Syrian refugees are coming to the United States is that the U.S. has no way of vetting them.

"How do you go about doing a background investigation on somebody who's coming from a war-torn country or comes from a country that's not friendly to us?" he asked.

"Do you think we dial up the Syrians and say, 'Well, we've got this guy here from your country claiming political asylum? Is he a bad guy?'" he added. "How effective do you think that would be?"

According to Cutler, terrorists have learned that the political asylum system is one that terrorists can exploit in the United States, as happened with the Boston Marathon bombers who "lied on their application . . . to qualify for asylum."

Cutler contends that Americans should view people who enter the United States without being properly inspected or vetted the same way as someone who sneaks by TSA agents at an airport.

"Would you get on an airplane if you saw people sneak past TSA?" he asked.

"We are now living with millions of foreign nationals whose identities and even countries of citizenship cannot be verified," he explained.

"We're granting them lawful status, we're granting them driver's licenses in many states with the asylum policies," he said.

"We are undermining our own national security," he added.
