President Donald Trump scored a victory on his controversial travel ban, but the issue is "moot," legal and media analyst Lionel told Newsmax TV on Monday.
In an interview with Newsmax TV’s Steve Malzberg, the LionelNation host on YouTube declared the ban is "not illegal."
"Whatever you call it, however you phrase it — I must say this I've never in my years of following the judiciary of our country seen … seen extra judicial statements" used in the way they have to rule against the travel ban, he said, referring to lower court references to Rudy Giuliani’s statements that Trump wanted him to draw up a legal basis for his "Muslim ban."
"There's nothing apparently unconstitutional with the ban — never has been," he insisted.
Lionel (nee Michael William Lebron) also decried the court case of a baker in Colorado who refused to make a cake for a same-sex couple, arguing, "since when does a private individual not have the right to say ‘I don’t want to be a part of this.’"
"The rule should be that the First Amendment, freedom of speech of individuals sometimes lends itself to very uncomfortable cases and that's the beauty of the Republic that we live in."
The New York Emmy Award winning personality also said he doesn’t believe that the speculated retirement of Justice Anthony Kennedy will move the balance of the court.
"It's about looking at the law and I don't think it matters" what their personal opinions are, he said. "I think that when it comes down to [it], once a justice is robed… they say 'So let me get this straight. They can't get rid of me yet? Good.'"
