Attorney Jordan Sekulow, a member of President Donald Trump’s legal team, told Newsmax TV on Wednesday that the lawsuit filed by Texas “is the outcome determinative case that we have been talking about,” in the 2020 presidential election.
Sekulow told “National Report” that if the Supreme Court “were to side” with Texas in the lawsuit filed by state Attorney General Ken Paxton, it “could change the outcome of the election.”
He said “there’s two resolutions, if you will, two ways to resolve this if the court sides with Texas … that the state legislatures of those states” that are being sued “have to pick a new slate of electors, and they’re all Republican legislatures in these states.”
Sekulow said the other option, if the court sides with Texas and states are unable to pick new electors, “then it would go to Congress.”
He noted that even though Democrats control the House of Representatives, “it’s actually by state delegation, and Republicans have a 27-22 margin there.”
