Alan Dershowitz: How 'One Sided' Is the FISA Process?

The recently released FISA warrant used to wiretap ex-Trump aide Carter Page leaves a number of questions unanswered — and could show how "one-sided" the process is, Harvard law professor Alan Dershowitz told Newsmax TV on Monday.

Dershowitz, author of "The Case Against Impeaching Trump," told "Newsmax Now" he expects to see more applications to the Foreign Intelligence Surveillance Act court in the wake of the document release.

"And it will show how one-sided the process is," he maintained.

Dershowitz said he is concerned the credibility of the so-called Steele dossier on which the warrant was based — compiled by ex-British spy Christopher Steele and paid for by the Democratic National Party and the Hillary Clinton campaign — was never brought up.

Instead, he noted, the government "said it was funded by people who had an interest in putting dirt on the presidential candidate . . . who was [then-candidate Donald] Trump."

"But it didn't specifically mention the relationship between the Clinton campaign, and you have to ask yourself why would they omit something like that," he said. "Why don't they just put it all out there and let the courts decide whether or not there was sufficient credibility."

"What we have to do is see the whole application," he added.

"If there was enough there without the Steele report, then usually the warrant is upheld," he said. "But if the Steele dossier played a major role and the government willfully and deliberately withheld information, that might have affected the judge's assessment of the credibility of the source. That could be a problem."

As it stands, Dershowitz said, "What we don't know is whether they would have made a different assessment if they had been given all the information."

"What I'd like to hear from the people who prepared the FISA warrant is why they didn't mention the fact that [Clinton] had essentially paid for" the Steele dossier that, because of some "very, very salacious material . . . really cast some doubt on the credibility of the person who prepared the dossier," Dershowitz said.
