Ex-Prosecutor: No Charges the Right Call in Beating Case

Police made a gutsy call in freeing a Florida man who said he beat his son's alleged rapist after walking in on the assault last week, a former prosecutor told Newsmax TV on Tuesday.

"A sense of fairness and justice" guided the Daytona Beach, Fla., police chief's decision not to pursue charges against the father, New York criminal defense lawyer Daniel Hochheiser told "MidPoint" host Ed Berliner.

But it's still a controversial decision, and the investigation may not be over, said Hochheiser.

Between the graphic arrest photo of the badly beaten rape suspect, Raymond Frolander, 18, and the natural tendency of authorities to worry about sanctioning vigilante acts, there could be a local grand jury investigation or a follow-up inquiry by federal law enforcement, said Hochheiser.

A trial for the father — whose name has not been released in order to protect his son's identity — seems unlikely, said Hochheiser, because "there is probably no Florida jury that would convict him."
